1. Acceptance of Terms
By accessing or using HugSend ("the App"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the App. These terms constitute a legally binding agreement between you and HugSend ("we", "us", or "our").
2. Eligibility
You must be at least 18 years old to use HugSend. By using the App, you represent and warrant that you are of legal age to form a binding contract. In some jurisdictions, parental consent may be required for users aged 13-17 for limited features.
3. Account Registration
To use certain features, you must register an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities under your account.
4. Acceptable Use
You agree not to use HugSend for any unlawful purpose or in any way that could damage, disable, overburden, or impair the App. Prohibited activities include: fraud, money laundering, sending spam, harassment, distributing malware, or violating any applicable law. All transactions are screened by Sentinel Global Pay for compliance.
5. Payments & Wallet
HugSend provides a multi-currency wallet and payment services. Funds are held in segregated accounts with regulated partners. You acknowledge that cryptocurrency and foreign exchange values may fluctuate. HugSend charges no hidden fees — applicable network and partner fees are displayed transparently before confirmation.
6. Hugs & Transfers
A "Hug" is a payment sent through the App. Once a Hug is confirmed and screened, it is generally irreversible. You are responsible for verifying recipient details before sending. HugSend reserves the right to delay or reject any transaction flagged by our compliance screening.
7. Marketplace & Escrow
The marketplace feature uses escrow protection. Funds are held until the buyer confirms receipt of goods/services. Disputes are resolved through our mediation process. Sellers must accurately describe items and fulfil orders promptly.
8. Intellectual Property
All content, trademarks, logos, and intellectual property in HugSend are owned by HugSend or its licensors. You may not copy, modify, distribute, or create derivative works without our express written consent. The HugMark logo and "Send a hug, send the love" tagline are registered trademarks.
9. Privacy & Data
Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy. By using HugSend, you consent to the collection, processing, and storage of your data as described therein.
10. Termination
We may suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or at your request. Upon termination, your right to use the App ceases immediately. Certain provisions (liability, indemnity, dispute resolution) survive termination.
11. Disclaimers
HugSend is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. To the maximum extent permitted by law, HugSend shall not be liable for indirect, incidental, or consequential damages arising from your use of the App.
12. Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in London, except where prohibited by law.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email or in-app notice. Continued use after changes constitutes acceptance of the revised Terms.
